2019 ACM Birth Photography Awards Terms and Conditions

  1. General

    1. The ACM Birth Photography Awards 2018 (Awards) are conducted by The Australian College of Midwives Ltd (ABN 49 289 821 863) of Level 1, 222 City Walk, Canberra, ACT, 2608 (ACM).

    2. Details of the Awards are set out in the Competition Description and these Terms and Conditions.

    3. Entry into the Awards is deemed to be acceptance of the Competition Description and these Terms and Conditions.

    4. Where there is any inconsistency between these Terms and Conditions and any other reference to the Awards, these Terms and Conditions prevail.

  2. Who Can Enter

    1. Aged 18 years or older; and

    2. Residing within Australia or living outside of Australia with Australian citizenship; and

    3. Includes photographers who provide commissioned or non-commissioned birth photography services; and

    4. Includes employees of ACM.

  3. How to Enter

  4. Any photographic image submitted to the Awards (Entry) must be submitted between [09:00 14 May and 09:00 15 July 2019] (Submission Period). No Entries will be accepted outside of the Submission Period. ACM accepts no responsibility for any late, lost or misdirected Entries.

    1. Entries must not be older than five (5) years from the date of submission.

    2. Entries must be uploaded through www.acmbirthphotographyawards.org  and comply with all requirements for uploading set out on the website.

    3. An entry fee of AUD$20.00 must be paid for each Entry.

    4. All entries must be new entries, entries into the 2017 or 2018 ACM Birth Photography Awards can not be resubmitted in the 2019 ACM Birth Photography Awards.

    5. All Entries must comply with the following specification:

      1. 8-bit, 3000 pixels on the longest side;

      2. 300ppi, Adobe RGB (not greyscale or sRGB); and

      3. saved as JPEG setting 12.

    6. Diptych, triptych and storyboards of single capture images are permitted and will be judged as one Entry.

    7. In the spirit of normalising birth, all entries must be a true representation of the original scene captured, free of any changes made by the photographer which affects the authenticity of the image.

    8. Entries must be original and without any watermark. Entrants are only permitted to make minor adjustments to an entry such as cropping, adjustments to brightness, contrast, sharpening and colour balance. Entrants are required to list any adjustments that are made.

  5. Guidelines and Requirements

    1. Entries must not:

      1. contravene any law, infringe the rights of any person or be obscene, defamatory, discriminatory, indecent, objectionable or inappropriate;

      2. condone or promote illegal activity

    2. Entries in which a person or medical facility (such as a hospital or birth centre) can be clearly identified will not be accepted, unless the entrant can produce evidence to ACM’s satisfaction that that person or medical facility has provided their written consent/a model release for the image to be used in the Awards. Means of identification include both written content, such as signs, nametags, medical records and equipment, and visual content such as a person’s face and physical appearance. In the case of a minor, written consent must be provided by their parent or guardian. ACM may request to inspect any written consent/model release and may request any additional documentation (including a statutory declaration) be signed to satisfy ACM that appropriate consent has been obtained. ACM reserves the right to reject any Entry at all times notwithstanding that consent has been obtained.

    3. Each entrant warrants and represents that they own all rights and interests in their Entry and that their Entry does not infringe the rights (including copyright, moral rights or other intellectual property rights) or privacy of any third party. ACM may request proof and documentation to support a claim of ownership, including a statutory declaration. ACM may reject an Entry if proof of ownership, to ACM's satisfaction, is not provided.

    4. Each entrant hereby indemnifies, and agrees to keep indemnified and defend and hold harmless, ACM from and against any and all claims made by any third party against ACM in relation to the entrant’s Entry.

    5. ACM reserves the right, in its sole discretion, to:

      1. refuse to accept an Entry it considers is in breach of these Terms and Conditions;

      2. disqualify and render invalid an Entry that ACM later determines to have been in breach of these Terms and Conditions; and

      3. recover any prize awarded for an Entry that ACM has determined to have been in breach of these Terms and Conditions.

  6. Rights and Licences

    1. All copyright remains with the entrant.

    2. Each entrant hereby grants to ACM a non-exclusive, license for the images to be used with the advertising or promotion of future ACM photographic competitions or related to the competition.

      1. ACM will undertake in all instances in our control to ensure all images are credited.

    3. Further to the above, and in consideration of the award prize, the 2019 ACM Birth Photograph of the Year winner (Winner) hereby grants to ACM a nonexclusive license,) to use their winning Entry for the advertising and promotion of ACM future photographic competitions or activities conducted by ACM (including the Awards) for a 12 month period.

    4. Where ACM uses an Entry pursuant to the licences described above, the entrant will be credited.

    5. ACM reserves the right to negotiate with an entrant for any long term use of image for promotional use and fee.

  7. Categories and Prizes

    1. 2019 ACM Birth Photograph of the Year – Pregnancy/Antenatal

      1. The top scoring print from this category will be deemed the winner.

      2. Prize: $1,000.00 AUD cash.

    2. 2019 ACM Birth Photograph of the Year – Labour and Birth

      1. The top scoring print from this category will be deemed the winner.

      2. Prize: $1,000.00 AUD cash.

    3. 2019 ACM Birth Photograph of the Year – Midwife

      1. The top scoring print from this category will be deemed the winner.

      2. Prize: $1,000.00 AUD cash.

    4. 2019 ACM Birth Photograph of the Year – Postpartum (birth to 6 weeks)

      1. The top scoring print from this category will be deemed the winner.

      2. Prize: $1,000.00 AUD cash.

    5. 2019 ACM Birth Photograph of the Year – Babies Born Still

      1. The top scoring print from this category will be deemed the winner.

      2. Prize: $1,000.00 AUD cash.

    6. 2019 ACM Birth Photograph of the Year

      1. The top scoring print from this category will be deemed the winner.

      2. Prize: $2,000.00 in store credit at Atkins Photo Lab.

    7. 2018 ACM Birth Photograph of the Year – People’s Choice

      1. All entries will be uploaded to this website under the People's Choice page, http://www.acmbirthphotographyawards.org and the public will have the opportunity to vote on their favourite images.

      2. The most “liked” image during the nominated timeframe will be deemed the winner.

      3. Prize: $1,000.00 AUD cash.

    8. Each of the award categories will include up to 3 finalists who will also receive a nominal prize. All finalists will receive a certificate for their professional portfolio.

  8. Judging

    1. All Entries will be judged by the nominated judges via zoom link and discussed.

    2. The 2019 ACM Birth Photograph of the Year – People’s Choice image will be judged via public vote via www.acmbirthphotographyawards.org.

    3. Judges scores and public votes will be collated across all categories and 18 finalist images (3 per category) will be selected from the highest scoring entries.

    4. Judges will be asked to consider the following criteria when providing a score for each Entry:

      1. Visual and Emotional Impact;

      2. Narrative/Story Telling/Social Impact;

      3. Imagination and Innovation; and

      4. Professional Photographic Technique/Representation.

    5. The judging panel will consist of:

    6. The judges have absolute discretion in selecting the finalists and winners. All decisions of the judging panel are final and binding on each entrant and are not subject to discussion or appeal and no correspondence will be entered into.

  9. Finalists and Winners

    1. Entrants chosen as finalists will be notified by 12 August 2019. Unsuccessful entrants are not personally notified.

    2. Finalists will be required to submit a full resolution, UN-WATERMARKED image of their Entry by 16 August 2019. Failure to submit that image by this date will mean the entrant will forfeit their finalist position and prize, resulting in the next highest scoring entry to take their place.

    3. All finalist entries will have their watermarked images displayed on https://www.midwives.org.au , and may also be displayed on other social media at the discretion of ACM.

    4. All finalists will receive recognition and gift from the ACM.

    5. Winners will be notified and acknowledged in an awards ceremony and cocktail party at the Australian College of Midwives National Conference in Canberra on the 17 September 2019.

    6. Winners will be acknowledged. Despite the 'preferred credit line' field on the entry form, the form of acknowledgement is solely at ACM’s discretion. It will usually consist of the entrant's name or the name of their business.

    7. Copies of finalists and winning Entries will be stored in ACM’s image library. The catalogue record will contain a caption and the name and contact details of the entrant.

  10. Privacy, Liability and Governing Law

    1. In order to conduct and promote the Awards, ACM collects entrants’ personal information (including their name, age and contact details).

    2. ACM may disclose the collected personal information to an agent engaged to undertake any aspect of the Awards. Entrants consent to their collected personal information being so disclosed for this purpose.

    3. ACM will handle the collected personal information in accordance with its Privacy Policy available at www.midwives.org.au/privacy-policy. Entrants will be considered customers of ACM for the purposes of its Privacy Policy.

    4. Except for any liability that cannot be excluded by law, ACM is not liable for and excludes all liability for any personal injury, loss or damage (whether direct, indirect or consequential) howsoever caused (including by negligence) arising from or in connection with the Awards, including without limitation:

      1. theft or misappropriation of, unauthorised access to or interference with an Entry;

      2. any technical or other malfunction associated with the promotion or running of the Awards;

      3. the judging of the Awards; and

      4. the delay, alteration, damage to or loss of any Entry or prize.

    5. The Awards and these Terms and Conditions are governed by the laws of the New South Wales. Each entrant irrevocably and unconditionally submits to the exclusive jurisdiction of the court of the New South Wales and any courts which have jurisdiction to hear appeals from any of those courts.
